Interview Summary

Ms. Connie Rakowsky emphasized the importance of accountability and transparency in civil disputes. She explained that people often disagree on facts due to differences in perspectives and in remembering the events. As a result, rather than focusing on the facts or the past events, it is important to agree on how to move forward. Transparency is important as the different parties need to understand what is happening from the other perspective, although she mentioned that transparency is not everything. 

 

In addition, while talking to Ms. Rakowsky, she mentioned the important aspects that are necessary in order to have a successful mediation. Firstly, she emphasized the necessity of the third party being neutral. A neutral third party will allow for no biases, and parties coming into the mediation process upset due to the unfairness of the mediator. Second, she talked about the parties listening to each other. In addition to just listening, the act of making sure the other party knows you are listening is also an important part of having a successful mediation. Through actions such as reflecting, asking questions, and making eye contact, the other party will be able to feel acknowledged and respected. Lastly, one of the most important mediation rules is letting go of the idea that all matters will conclude. Ms. Rakowsky emphasized that not all matters may be resolved. In many cases, as people are not willing to hear different perspectives or want a “victory” for themselves, this often leads to increased clashing, rather than resolution.  Without honesty, respect, and a willingness to move forward, mediation efforts become ineffective.
